Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 1st and 2nd Respondents to stop the illegal construction by the 5th Respondent by violating the Planning permit and to Demolish the unauthorized structure and pillars located in the way of setback at Grand Ellora Villa MK Stalin Road Thazhambur Chennai -130. For the Reason stated above it is prayed that this Honble Court may be pleased to permit the 1st Petitioner to represent the other Petitioner in this Writ Petition and further direct the 1st Respondents to inspect the entire Grand Ellora Project an for compliance especially with regards to Environment Impact Assessment not done.

(By D.Krishnakumar,J.,) When the matter is taken up for hearing, it is represented by the learned counsel for the 2nd respondent that on earlier occasion, Panchayat had issued a show cause notice to R5 for violation of the planning approval. It is further represented that a fresh show cause notice would be issued to R5 for violation / deviation. 2/4

In view of the above submission, this Writ Petition is disposed of, with a direction to the 2nd respondent to issue fresh show cause notice and based on the explanation to be submitted by the 5th respondent, the 2nd respondent shall proceed further and act in accordance with law. The whole exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
