Prayer : Writ petition filed under Article 226 of the Constitution of India seeking to issue a Writ of Certiorarified Mandamus, to call for the records in Lr.No.1047/Pa.A4/05-7 dated 06.06.2008 received by the petitioner on 25.06.2008 issued by the 1st respondent and quash the same and further direct the respondents to include the name of the petitioner, after refixing the seniority in the cadre of Assistant and to promote him to the post of Block Development Officer on the dates on which his juniors were promoted and to give monetary benefits. ORDER
This writ petition has been filed seeking to issue a Writ of Certiorarified Mandamus, to call for the records in Lr.No.1047/Pa.A4/05-7 dated 06.06.2008 received by the petitioner on 25.06.2008 issued by the 1st respondent and quash the same and further direct the respondents to include the name of the petitioner, after re-fixing the seniority in the cadre of Assistant and to promote him to the post of Block Development Officer on the dates on which his juniors were promoted and to give monetary benefit.
2. On 08.12.2011, a proceedings dated 26.10.2012 was placed before this court. In the Seniority list annexed to the above proceedings, only the first petitioner's name L.Elangovan find place in Sl.No.7, in the Cadre of Block Development Officer. Therefore, this matter is posted today, under the caption "being mentioned" for clarification.
3. The learned Special Government Pleader submitted that, since the first petitioner name is find place in the Seniority list in the cadre of Block Development Officer, the writ petition may be dismissed as infructuous, as against the first writ petitioner.
4. As far as the second petitioner is concerned, the learned counsel appearing for the petitioners submitted that pending writ petition, the second writ petitioner namely V.Kaveri, had retired from service on superannuation and hence, no further order is required for further adjudication in this writ petition.
5. Inview of the above submissions, this writ petition is dismissed as infructuous. No costs.
