ORDER
The revision challenges the order passed by the learned Magistrate dismissing the petitioner's application under Section 175(3) of BNSS.
2. The petitioner had lodged a complaint against the proposed accused stating that they had cheated the petitioner of a sum of Rs.15 lakhs by making false representations. The petitioner had lodged the complaint before the second respondent herein, which was closed with an observation that a similar complaint was pending against the proposed accused before the CCB, Chennai, and that the petitioner may seek appropriate remedy. The petitioner sought a direction to register an FIR, which came to be dismissed by the impugned order.
3. Considering the submissions made on either side, this Court is of the view that the petitioner can approach the Inspector of Police, CCB, Chennai, who is investigating Crime No.206 of 2023, with her complaint.
4. The Investigating Officer shall conduct a preliminary enquiry and, if any cognizable offence is made out, may either treat her as a victim in Crime No.206 of 2023 or register an independent FIR. 2 / 4
5. With the above observations and directions, this Criminal Revision Case stands disposed of.
