O R D E R
(Order of the Court was made by P.Velmurugan, J.) This writ petition has been filed seeking a direction to respondents 1 and 2 to grant 30 days' ordinary leave, without escort, to the life convict, namely, Paraman @ Paramasivan, S/o.Sivanvelar, aged about 33 years, (Prisoner No.20511, PID No.43198), who is presently confined at Central Prison, Coimbatore, by considering the representation of the petitioner dated 07.01.2026.
2. Heard both sides and perused the materials available on record.

It is the case of the petitioner that she made a representation dated 07.01.2026 to the respondents seeking grant of 30 day's ordinary leave, without escort, to her brother Paraman @ Paramasivan, S/o.Sivanvelar, aged about 33 years, (Prisoner No.20511, PID No.43198) in order to enable him to perform his marriage scheduled to be held on 28.01.2026. However, the said representation has not been considered by the respondents, and hence, the present petition.

Per contra, the learned Additional Public Prosecutor appearing for the respondents-Police submitted that the representation of the petitioner dated 07.01.2026 has already been considered and rejected by the competent authority on 22.01.2026. He further submitted that as per the Tamil Nadu Prison Manual (Volume III) and Rule 22 of the Tamil Nadu Suspension of Sentence Rules, 1982, a convict prisoner who avails ordinary leave becomes eligible to apply for the next spell of ordinary leave only after completion of one full year of sentence from the date of re-admission into prison upon return from such leave. In the present case, the said convict prisoner had earlier been granted leave by this Court and was re-admitted into prison on 24.06.2025. Since he has not completed one full year from the date of such re-admission, he is not eligible for ordinary leave. Therefore, the representation was rejected, and hence, the relief sought for in this writ petition has become infructuous.

In view of the above submission made by the learned Additional Public Prosecutor that the petitioner's representation dated 07.01.2026 has already been rejected by the competent authority on 22.01.2026, nothing survives for adjudication in this writ petition. Accordingly, this Writ Petition is dismissed as infructuous.
