Sumangala v. M.B.Mahesh(Died)

This petition is filed to transpose the defendants 7 and 8 to be the appellants 2 and 3, who were arrayed as respondents 7 and 8 in the appeal.
2. The reason stated in the affidavit is that the sole appellant viz. M.B.Mahesh, who is the plaintiff in the suit had lost the suit, has died pending appeal leaving behind his wife Sumangala. Likewise, the 8th respondent Sarvamangala W/o. K.C.S.Panchakshari, died pending appeal leaving behind the 2nd petitioner/ 8th respondent / 8th defendant Smt.Leelavathi.
3.In the light of the death of Sarvamangala, the life interest of the Will is the subject matter of the suit. The transposition of respondents 7 and 8 is eminent for effective disposal of the lis. Hence the petition is allowed. The respondents 7 and 8 are transposed as the appellants 2 and 3.
4.The appellant is directed to file a clean copy of memorandum of grounds within three working days.
5.List the matter for final disposal on 18.03.2022.
