Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Certiorarified Mandamus, calling for the records pertaining to order dated 14.12.2021 in S.A.No.632 of 2021 on the file of DRT, Coimbatore and quash the same as illegal and arbitrary and further direct the DRT, Coimbatore to consider the S.A.No.632 of 2021 on merits based on the grounds raised and dispose of the same within the time frame.

O R D E R

(Order of the Court made by M.DURAISWAMY,J.) The petitioner has filed the above Writ Petition challenging the order passed in S.A.No.632 of 2021, dated 14.12.2021, on the file of the Debts Recovery Tribunal, Coimbatore.

2. Since the petitioner has got remedy by way of filing an appeal under section 18 of the SARFAESI Act, before the Debts Recovery Appellate Tribunal, we are not inclined to entertain the Writ Petition. Accordingly, the Writ Petition is dismissed. However, it is open to the petitioner to challenge the order dated 14.12.2021 made in S.A.No.632 of 2021 under section 18 of the SARFAESI Act, in accordance with law. No costs.

Consequently, connected Miscellaneous Petition is closed.
