ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.12.2025, for the alleged offence punishable under Sections 331(4), 305(a) of BNS in Crime No.444 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner joined hands with two other accused, entered into the church, broke open the almirah, and taken away cash and other properties worth about Rs.3 lakhs. Hence, the case has been registered based on the CCTV footages.

3. Learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody from 13.12.2025 and already Rs.81,000/- has been recovered, and the petitioner is not having any previous case. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that all three accused were arrested and only Rs.81,000/- has been recovered, and the investigation in this case is pending; Hence, he opposed for grant of bail to the petitioner.

5. Considering the nature of the offence and the fact that the petitioner is in judicial custody only from 13.12.2025 and the major part of the money has not been recovered, this court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed. 29-01-2026 Mpa
