C.Chitra ..Respondent Though the case is not listed today, it is taken up for settlement at the instance of both the parties. The learned counsel for the appellant,Mr.K.J.Sivakumar, is Present. The learned counsel for the respondent Mr. R.Govindaraj is present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT Both the parties and their respective counsels are present. 2.The Tribunal has awarded a sum of Rs. 10,62,800/- with interest at 7.5% p.a. from the date of petition till the date of deposit as compensation.

3. Aggrieved by the award of the tribunal, the Appellant/Transport Corporation has preferred the present appeal.

4. Now the parties mutually agreed to settle and modify the award for a sum of Rs. 14,50,000/- (Rupees Fourteen Lakhs Fifty Thousand Only) together with interest. The learned counsel for the appellant submitted that the appellant Transport Corporation has already deposited Rs.16,00,000/- before the tribunal. 5.In view of the above settlement, after satisfaction of the decree, the tribunal is directed to refund the balance award amount with proportionate interest to the Appellant/Transport Corporation.

6.The Tribunal is directed to issue the cheques to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. The Managing Director, State Express Transport Corporation Ltd., Chennai-600002.
