Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to transfer the
petitioner to Primary Health Centre, Vadalur, Vadukacheri Block, Nagapattinam District by considering her representation dated 19.10.2023 within the time stipulated by this Court.
In all W.Ps For Petitioners : Mr.T.Thirumurugan For Respondents : Mr.G.Ameedius Government Advocate COMMON ORDER All these Writ Petitions have been filed for direction directing the respondents to transfer the petitioners as requested by them.
2. Heard the learned counsel appearing for the petitioners and perused the materials available on record.
3. The petitioners were appointed in the fourth respondent as Multi Purpose Hospital Worker at Primary Health Centre in various places at Nagapattinam District. However, all the petitioners were residing at Nagapattinam and it is 65 k.ms. away from the work place. Therefore, they submitted representations to transfer them to their native block on 19.10.2023.
4. On instructions, the learned Government Advocate appearing
for the respondents submitted that the petitioners were appointed on contract basis. There is no vacancy in the Primary Health Centre in their respective place as requested by the petitioners. Already the Multi Purpose Hospital Workers were appointed in Nagapattinam and right now they are working. As per G.O.No.689, Health and Family Welfare Department, dated 27.06.2022, transfer could not be conducted for the Multiple Purpose Hospital Worker, since they are appointed on contract basis on the daily wages.
5. In view of the above, the writ petitions are devoid of merits and are liable to be dismissed. Accordingly, these writ petitions stand dismissed. No costs.
