ORDER

This Criminal Original Petition has been filed seeking to call for the records in CSR No.293 of 2021 dated 26.08.2021 on the file of the V1 Vazhapadi Police Station, Salem District and direct the first respondent to give protection to the petitioner and his property.

2. When the matter is taken up for hearing, Mr.A.Gokulakrishnan, learned Additional Public Prosecutor appearing for the first respondent would submit that the matter relates to civil dispute regarding the property under Patta No.889 in survey no.146/6, Patta No.889 in Survey no.148/1, Patta No.889 in Survey No.183/2, Patta No.193 in Survey no,148/2 and Patta No.193 in Survey No.147/2 in Ponnarampatti Village, https://hcservices.ecourts.gov.in/hcservices/

Vazhapadi Taluk, Salem District. In respect of the properties, a civil suit is pending between the second respondent/plaintiff and the petitioner/defendant on the file of the learned Additional District and Sessions Judge, Fast Track Court No.1, Salem.

3. The first respondent conducted an enquiry in CSR.No.293 of 2021 and finding that the civil disputes are pending between the parties, they were directed to approach the concerned Civil Court and get appropriate orders.

4. The learned Additional Public Prosecutor would further submit that the first respondent undertakes to give suitable protection subject to the outcome of the civil suit.

5. Recording the submission, this Criminal Original Petition stands disposed of.
