ORDER

Alleging that respondents 7 and 8 relied on a false family tree and registered partition deed dated 06.07.2023, after submitting multiple representations seeking cancellation thereof, the present writ petition has been filed.

2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for respondents 1 to 5. Adverting to the representations, he submits that the petitioner has requested for cancellation, and that such power of cancellation is not vested in the registering officer.

3. From the averments in the affidavit, it appears that there is a title dispute in respect of the property and the petitioner alleges that partition deed dated 06.07.2023 was executed and registered on the basis of an incorrect family tree. Evidently, there are disputed questions of fact which could be appropriately adjudicated through a trial process in a civil court. Leaving it open to the petitioner to approach the jurisdictional civil court for relief, this writ petition is disposed of. No costs.
