O R D E R
This Writ Petition has been filed challenging the proceedings dated 29.02.2016 issued by the first respondent in appointing the fourth respondent as Noon Meal Organizer in the third respondent school.
2. On behalf of official respondents counter affidavit has been filed.
3. This matter went several adjournments. After hearing both side, this Court directed the official respondents by order dated 25.04.2025 to file a report with regard to the distance criteria for appointment of candidates in the Noon Meal Centre and also criteria for awarding marks for selection and also to furnish the address of the fourth respondent. Accordingly, the first respondent has filed an affidavit on 19.06.2025. Being dissatisfied with the contents in the said affidavit, which are not answered the clarifications sought by this Court in its order dated 25.04.2025, this Court directed the first respondent to be present before this Court with all original connected records.

Accordingly, the first respondent present before this Court along with all connected records and also filed an additional affidavit wherein, it is stated that he joined duty in the post on District Collector, Tiruvannamalai on the Forenoon of 03.02.2025 and the order of appointment under challenge in this writ petition is pertaining to the year 2016. On verification of the records, to file an additional affidavit before this Court, it is found that the fourth respondent was allotted 5 marks under the distance criteria in violation of the instructions of the first respondent and also contrary to the G.O.(Rt.) No.163 Social Welfare and Noon Meal Programme (NMP-2) Department dated 18.08.2010. Immediately, the first respondent issued proceedings in Na.Ka.16236/2018/NMP-1 dated 24.06.2025 cancelling the appointment of the fourth respondent made on 29.02.2016.
5. It is also averred in the said additional affidavit that for the interview conducted for the said post, 13 candidates appeared for interview before the selection committee and the petitioner secured 23 marks and some other candidates secured 24 and 27 marks also.
6. Considering the contentions of the first respondent in his additional affidavit that the appointment order issued in favour of the fourth respondent on 29.02.2016 has been cancelled vide proceedings dated 24.06.2025, in our considered view, no further adjudication is required on that aspect. 3/6

However, considering the facts and circumstances of the case, appropriate direction can be issued to the first respondent to review the entire selection process and examine the records of the selection committee awarding marks to 13 candidates under different heads and then the first respondent shall issue orders for appointment of the suitable candidate to meet the interest of justice, due to the reason that now, in the light of the proceedings issued by the first respondent on 24.06.2025, the vacancy of Noon Meal Organizer in the third respondent school has to be filled with the suitable and eligible candidate.

For the above said reasons, this Writ Petition is disposed of with a direction to the first respondent to re-examine the entire selection process made for appointment of Noon Meal Organiser in the third respondent school and re-visit the marks awarded to the 13 candidates attended for the interview and appoint more eligible and suitable candidate for that post, within a period of two weeks from the date of receipt of copy of this order.
