This application has been filed by a third party seeking to participate in the Writ Petition as fouth respondent. 2.

It had been stated that the petitioner/third party had disbursed huge amount to its customer, who had committed default. It is stated that the amount disbursed was public money and it was so disbursed only on the assurance and guarantee coverage given by the Government of India. It has therefore been stated that they are required to be heard before any order is passed. 3.

It is also stated that the petitioner could not prosecute their recovery proceedings either under the Arbitration and Conciliation Act or under any proceedings under common law. 4.
