Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus directing the respondent to consider the claim of the petitioner for promotion as Asst. director of Local Fund Audit without reference to the punishment imposed by the 1st respondent in G.O.(2D) No.25 Finance (Local Fund) Department dated 17.03.2008 and promote the petitioner as Asst. Director and grant him all consequential service monetary benefits.

The learned counsel appearing for the petitioner submitted that the Writ Petition was filed challenging the denial of promotion to the petitioner. He further submitted that pending Writ Petition, the petitioner was promoted and hence nothing survives in the Writ Petition. He has also made an endorsement to that effect.
