Seeking a direction to the third defendant to deposit the title deeds of the suit property, the applicant/plaintiff has come up with this application.

2.There is no necessity to pass an order in this application in view of the submission made by the learned counsel for the applicant that the suit can be expedited. Further more, even on merits, this Court does not find any reason to allow this application. The suit is only for specific performance. The memo of understanding has been entered into in the year 2002. The application is neither incidental nor relevant to the main relief sought for. Accordingly, the application stands closed.

3.Post the suit for framing issues along with C.S.No.439 of 2015, said to have been filed by the second defendant in the present suit, on 29.11.2016.
