Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the 2nd respondent in his order dated 19.08.2011 passed in PG.No.230 of 2009 and to quash the same and to further forbear the respondents from demanding the Payment of Rs.24,299/-(Rupees Twenty Four Thousand Two Hundred and Ninety Nine Only) along with 10% simple interest from the date it became due to till the date of payment of gratuity under the P.G.Act 1972. O R D E R

The learned counsel for the writ petitioner made a submission that the gratuity amount had already been settled, except an amount of Rs.24,299/-, which is yet to be paid to the first respondent /employee.

2. In view of the submissions that the employee concerned died, the gratuity amount has been settled in favour of the legal heirs. The writ petitioner is directed to pay the compensation amount of Rs.24,299/-(Rupees Twenty Four Thousand Two Hundred and Ninety Nine Only) to the legal heirs of the deceased employee within a period of eight weeks from the date of receipt of a copy of this Order.

3. With these observations, the writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
