ORDER

The writ petition is filed seeking a mandamus to the respondent to pay his 1/4th share in the award amount, based on his representation dated 07/10/2024.

From the narration in the affidavit, it appears that the property in S.No.569/3 and 569/4 in Karagathhalli Village, Palacode Taluk, Dharmapuri District is his ancestral property, in which, the petitioner, his father and brother have a share. The patta for the said property reflects the name of the petitioner too. According to the petitioner, his land was acquired by the Government and an award came to be passed for a sum of Rs.70,20,430/-. While the other sharers have been awarded their respective shares, the petitioner was not paid his original share of compensation till date. Despite several requests made by the petitioner both orally and also through representations, there was no response from the respondent. He therefore had submitted a detailed representation on 07.10.2024, to disburse his award amount of Rs.17,55,107/-, which also yielded no desired result from the 2/4

respondent. Hence, this writ petition.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader, who takes notice for the respondent.

Considering the limited request made by the petitioner and the fact that the respondent herein have not bothered to reply to the petitioner's representation or had taken action, a mandamus is issued to the respondent to consider the representation of the petitioner dated 07.10.2024 and disburse the 1/4 share of the compensation of the award amount, if not already done, after issuing notice to the other co-sharers and upon hearing them, within a period of three months from the date of receipt of a copy of this order.
