When the matter was taken up for hearing, the learned counsel for the petitioner conceded that the order dated 02.03.2023 has not been complied with by the petitioner.
2.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that this Court had granted bail to the petitioner on 13.02.2023 with the condition to deposit a sum of Rs.5 lakhs to the credit of Cr.No.1 of 2022 before the concerned Magistrate within a period of two weeks from the date of release. Subsequently, the petitioner was unable to mobilize the funds and thereby this Court by order dated 02.03.2023, also extended time till 16.03.2023 to deposit the amount. In the order dated 02.03.2023, this Court made it clear that if the petitioner fails to comply with the condition, the order dated 13.02.2023 would stand automatically cancelled without any further extension.
3. In view of the above, the order dated 13.02.2023 shall stand cancelled. The respondent is permitted to take steps in accordance with law. 19.04.2023 jas
