This Civil Miscellaneous Petition has been filed seeking to condone the delay of 106 days in filing the above Civil Miscellaneous Appeal against the award dated 04.05.2023 passed in E.C.No.9 of 2017, on the file of Commissioner, Workmen's Compensation Tribunal, DCL-I, Chennai.

2. Mr.S.Arun Kumar, learned counsel for appellant submitted that after receipt of copy of award, it was forwarded to the previous company on 17.08.2023 and subsequently, after obtaining opinion from the counsel attached with the appellant insurance company, the appeal was filed on 20.01.2024, however, there is a delay of 106 days in filing the above Civil Miscellaneous Appeal arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Civil Miscellaneous Appeal.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition.
