Respondents Writ petition has been filed under Article 226 of the Constitution of India, praying for a Writ of Certiorarified Mandamus, to quash the election notice dated 07.08.2018 for the E.H.113 Chennimalai Kongu Primary Weavers Co-operative Society for the election to be held on 11.08.2018 based on the list of candidates finalised and declared eligible by the third respondent on 07.08.2018 as the same has been done without scrutinising the applications submitted by the petitioners, contra to the Tamil Nadu Co-operative Societies Act, 1988 and directing the respondents to publish a fresh list of candidates submitted their nominations followed by the eligible list of candidates to contest for the election.

ORDER

The learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to challenge the election and he has also made an endorsement to that effect.

2. In view of the submission and endorsement made by the learned counsel for the petitioner, the writ petition is dismissed as withdrawn with liberty to challenge the election held to the third respondent society in the manner known to law. No costs. Consequently, connected miscellaneous petitions are closed.
