The petitioners, who apprehend arrest by the respondent police for the offences punishable under Section 303 of BNS and 21(1) and 21(4) of the Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.Not known of 2026 registered on the file of the respondent police seek 1/6
anticipatory bail.

The case of the prosecution is that the petitioners are the land owners and they leased out the land for the purpose of taking sand and also for running the bricks illegally, even after the premises had been sealed by the competent authority. Hence, a case has been registered against the petitioner.
3. The learned counsel appearing for the petitioners submitted that the petitioners are the land owners and they have been falsely implicated in this case. He further submitted that they have no previous cases pending against them. Hence, he prays to grant anticipatory bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioners run SPS Chamber Bricks under the lease agreement at Madhampatti Village, Karadimadai Road after sealing the factory illegally. He further submitted that the petitioners have no previous cases pending against them. Hence, he opposed the grant of anticipatory bail to the petitioners.
5. Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Criminal Side) appearing for the respondent police and perused the materials available on record.
6. This Court has earlier considered the anticipatory bail petition 2/6
filed by a similarly placed co-accused in Crl.O.P. No.30964 of 2024, by order dated 12.12.2024. Taking into account the said order and the fact that the case has been registered in the year 2024, this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions.

Accordingly, the petitioners are ordered to be released on anticipatory bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned Judicial Magistrate No.I, Coimbatore on condition that the petitioner shall execute a separate bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand Only), each with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:
(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(b) the petitioners shall report before the respondent police, daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation;
(c) the petitioners shall not tamper with evidence or witness either during investigation or trial; 3/6
(d) the petitioners shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;
(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 28.01.2026 drl To 1.The Judicial Magistrate No.I, Coimbatore.
