ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(a) r/w. 24(1) of Cigarette and Other Tobacco Products Act 2003 and 123 of BNS, 2023 in Crime No.11 of 2026, seeks anticipatory bail.

2. The allegation against the petitioner/A2 is that the petitioner, in collusion with other accused, was found in possession of 3 kgs of banned Tobacco Products, which were recovered from the petitioner's shop. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and has been falsely implicated in this case. He also submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court, and therefore, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that there are two previous cases of a similar nature pending against the petitioner and the

property has been recovered from the petitioner's shop. Hence, she opposed the grant of anticipatory bail to the petitioner.

5. Considering the nature of the offence committed by the petitioner, and taking note of the fact that there are 2 previous cases of a similar nature pending against the petitioner and the contraband was recovered from the petitioner's shop, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
