C.M.P.No.1627 of 2022 in A.S.No.468 of 2013 S.KANNAMMAL, J.

It submitted by the learned counsel for the petitioner/appellant that since his name was not printed in the cause list on 16.11.2021, he could not represent the matter. Hence, the appeal was dismissed for non-prosecution on 16.11.2021. Now, the petition is filed seeking to set aside the order dated 16.11.2021 made in A.S.No.468 of 2013.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent-1.

3. The learned counsel for the respondent-1 has no objection for allowing this petition.

4. Upon hearing the learned counsel on either side and on being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and A.S.No.468 of 2013, is restored to file.

5. Post the appeal on 17.03.2022 'for final hearing'.
