PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to set aside/modify the impugned order dated 30.11.2023 made in Crl M.P.No.30845 of 2023 in Criminal Appeal No.747 of 2023 by the Principal District and Sessions Judge at Chennai imposing condition for execution of Bond for 10,000/- with two sureties with a further condition to deposit 20% of the compensation amount to the credit of STC.No.188/2023 for the suspension of sentence dated 03.11.2023 made in STC No.188 of 2023 by the Metroplitan Magistrate, FTC-II Egmore at Allikulam. ORDER
This criminal original petition has been filed challenging the condition imposed by the Court below directing the petitioners to deposit 20% of the compensation amount as a condition for suspension of sentence. 2.The above order was passed on 30.11.2023 and till date this condition has not been complied with. This order copy was made ready as early as on 08.12.2023. However, the petitioner has chosen to file this petition on 30.01.2024 and challenge the condition imposed by the Court below. 3.This Court does not find any merits in this criminal original petition and accordingly the same is dismissed. Time is granted to the petitioner to deposit 20% of the compensation amount, within a period of four weeks from today. If the amount is not deposited, the Court below shall proceed to cancel the order of suspension of sentence and secure the petitioner to undergo the sentence imposed by the trial Court.
