Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to implement Thaiyur Housing Scheme commenced by the respondents in the year 2000, thereby allot plot measuring 1800 sq.ft to the petitioner.. Heard Mr.M.V.Venkataseshan, learned counsel for the petitioner, Mr.V.Selvaraj, learned Additional Government Pleader for the respondents 1 to 3 and Mrs.T.Girija, learned Advocate appearing for the fourth respondent.
2. The petitioner seeks for issuance of a Writ of Mandamus, directing the respondents to implement Thaiyur Housing Scheme commenced in the year 2000, thereby allot plot measuring 1800 sq.ft to him.
3.The learned counsel for the petitioner submitted that the petitioner made a representation dated 26.08.2015 through RPAD to the third respondent, namely, The Deputy Registrar (Full Additional Incharge), Housing, Madras Circle to implement Thaiyur Housing Scheme commenced in the year 2000, thereby allot plot measuring 1800 sq.ft to him. As the said representation has not considered by the third respondent, the petitioner has filed the writ petition with the above said prayer. He further submitted that it would be suffice to direct the third respondent to consider the petitioner's representation dated 26.08.2015 within a time frame, that may be fixed by this Court.
4. The learned counsel appearing for the respondents 1 to 3 has submitted that the said representation will be considered, on merits and in accordance with law.
5. In view of the submission of the counsel for both sides, this Court is inclined to direct the third respondent to consider petitioner's representation dated 26.08.2015 and pass orders, on merits and in accordance with law as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order, after providing opportunity to the fourth respondent. Needless to say that the petitioner is directed to furnish one more copy of the representation along with a copy of this order.
6. With the above observation and direction, the Writ Petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
