3 DRIVER RAJA P.C.NO.1652, (EICHEER POLICE VAN TN 23 G 0463) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit to withdraw minor childerns interest amount which is deposited in the credit of MCOP No.211/2007 on the file of the Learned Motor Accident Claim Tribunal, Vellore order dated 17.07.2009 and pass such further or other order as it may deem fit and proper in the circumstances of the case and thus render justice In CMP No.3502 of 2018.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof

and upon hearing the arguments of M/S.M.RAJENDIRAN, Advocate for the petitioner and of M/S. M.VENKADESH KUMAR (G.A.CC.S) on behalf of the Respondents the court made the following order:- This petition is filed seeking permission to withdraw minor children interest amount which is deposited in the Credit of MCOP No.211 of 2007 on the file of the learned Motor Accident Claim Tribunal, Vellore.

2.The learned counsel for the petitioners states that this Court by order dated 10.03.2011 has permitted the first and fourth petitioners to withdraw their share amount but no direction was issued as far as second and third petitioners due to the reason that they are minors.

3. Considering the submissions made by the learned counsel for the petitioners the first petitioner is permitted to withdraw the accrued interest in respect of share amount of second and third petitioners, once in three months, for their maintenance, till they attain majority.

4. This petition is ordered accordingly.
