O R D E R

This petition has been filed challenging the order passed by the Court below dismissing the relaxation petition filed by the petitioner.

2.The petitioner was arrested by the respondent police in Crime No.301 of 2018 for an offence under Sections 341, 143, 365, 386 and 506(ii) I.P.C. The petitioner filed a petition for bail and bail was granted by the Court below by imposing a condition that the petitioner should appear daily before the respondent police at 10.00 a.m and 5.00 p.m. until further orders. The petitioner was complying with the condition by reporting before the respondent police at 10.00 a.m. daily from 01.12.2018 onwards.

3.The Court below dismissed the petition seeking for relaxation on the ground that the petitioner did not report on all days as directed by the Court below.

4.In the facts and circumstances of the case, this Court is of the considered view that the petitioner has been been reporting before the respondent police for more than 46 days. Therefore, the condition imposed by the Court below can be modified.

5.This Criminal Original Petition is disposed of by modifying the the condition imposed by the Court below by directing the petitioner to report before respondent police once in a week i.e., every Monday at 10.00 a.m for a period of four weeks and thereafter report before the respondent police as and when required for interrogation.
