Chakkubai Ammal v. Govindarajulu Naidu (Died)

C.M.P.Nos.2237, 2240 & 2242 of 2023 in S.A.No.1316 of 2006 G.ARUL MURUGAN , J., It is reported that the second respondent R.Vijaya died.

2. The above petitions have been filed to substitute the legal heirs/proposed 7th and 8th respondent; to condone the delay of 180 days and to set aside the abatement to bring legal heirs on record.

3. Notice has been served on 13.03.2023 to the proposed respondents 7 and 8 and their names are printed in the cause list.

4. Perused the affidavit and satisfied with the reasons stated therein. Accordingly these CMPs are ordered as prayed for and delay is condoned.

5. Registry is directed to carry out the necessary amendment.

6. Issue notice to the impleaded respondents 7 and 8 in the second appeal returnable by 30.01.2024. Private notice is also permitted.
