ORDER

This Writ of Mandamus has been instituted to direct the respondent to renew the petitioner's passport vide No.L7805339 without reference to the criminal case pending against the petitioner in Crime No.349/2023 on the file of the Palacode Police Station, Dharmapuri District. 2.It is not in dispute that the criminal case has been registered in Crime No.349/2023 against the petitioner. The Criminal case is under investigation.

3.The petitioner submitted an application for renewal of passport and there is no impediment for renewal of passport. However, after the renewal, the Regional Passport Officer is directed to surrender the passport before the jurisdictional Criminal Court where the criminal case is pending. If at all the petitioner has to travel abroad he has to file necessary application before the jurisdictional Criminal Court and the Court has to consider and take a decision. Thus, the respondent shall renew the passport by following the

due process and surrender the passport directly to the jurisdictional police station who in turn shall surrender before the competent Criminal Court. With this direction, this Writ Petition is disposed of.
