Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 16.02.2009 for appointment to the post of existing vacancy of Village Assistant in the Cheyyur Taluk. ORDER

When the matter was taken up for consideration, the learned Additional Government Pleader appearing for respondents, on instructions, submitted that the post of "Grama Kavalar" is no longer in existence and hence, nothing survives for adjudication in this writ petition.

2. In view of the submission so made by the learned Additional Government Pleader, the learned counsel for the petitioner sought liberty to the petitioner to submit a fresh representation to the respondents seeking appointing to the post of Village Assistant.

3. Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on https://hcservices.ecourts.gov.in/hcservices/

either side, this Court disposes of this writ petition granting liberty to the petitioner to file a fresh representation, if he satisfies the eligibility criteria, before the respondent authorities, within a period of three weeks from the date of receipt of a copy of this order. On such filing, the respondent authorities shall consider the same and pass appropriate orders, on merits and in accordance with law, after affording due opportunity of personal hearing to the petitioner, within a period of six weeks, thereafter. No costs.
