Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus to direct the 1st and 2nd respondents to consider the petitioner representation dated 20.11.2017.

O R D E R

This writ petition is filed seeking for a mandamus directing the first and second respondents to consider the petitioner's representation dated 20.11.2017, wherein and whereby, he called upon the first respondent herein to prevent the conduct of Kabadi tournament scheduled to take place on 25.11.2017 and 26.11.2017.

It is seen that the 3rd respondent herein has already approached this Court and filed W.P.No.29035 of 2017 seeking for a direction to the Police Department and give necessary permission for conducting the State Level Kabadi tournament on 25.11.2017 and 26.11.2017 at Kandipalayam Village, Namakkal District and this Court, by an order dated 14.11.2017 directed the Inspector of Police to consider the request of the petitioner therein (3rd respondent herein) to pass appropriate orders on merits and in accordance with law on or before 20.11.2017. When such an order is already passed by this Court, the present writ petition is filed by the petitioner herein seeking for considering his representation 20.11.2017 to prevent the conduct of such tournament.

4. It appears that there is some private dispute between the petitioner and the 3rd respondent which is sought to be settled before this Court by way of filing this writ petition. If the petitioner has any grievance against the conduct of such tournament, he ought to have approached the Police Department and made their objection well in advance. Instead of doing so, the petitioner has made such objection only on 20.11.2017, by which time this Court has already passed an order in the earlier writ petition as stated supra, directing the second respondent to pass orders on or before 20.11.2017. Therefore, I find that the present writ petition is totally misconceived and consequently, the same is dismissed as not maintainable. No costs.
