ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus to direct the 2nd respondent to expedite and dispose the Appeal No.A1/4233/2021 dated 06.10.2021 within a time frame as may be fixed this Court.

2. The learned counsel for the petitioner submitted that it would suffice if a direction is issued to the 2nd respondent to dispose of the petitioner's appeal dated 06.10.2021 within a stipulated time as may be fixed by this Court.

3.Mr.R.Neethi Perumal, learned Government Advocate takes notice for the respondents 1 and 2. Since no adverse order is being passed against the respondents 3 and 4, notice to the respondent 3 and 4 is dispensed with.

4. Having regard to the submissions made by the learned counsel on either side and since the Writ Petition is filed seeking a simple Writ of Mandamus to dispose of the appeal dated 06.10.2021, this Court without expressing any opinion with regard to the merits of the case, directs the 2/5

2nd respondent to issue notice of appeal to the petitioner, private respondents herein, rival claimants/interested parties if any as the case may be and after giving notice, hear the appeal on merits and dispose of the appeal dated 06.10.2021 on merits and in accordance with law, if the appeal was already not disposed of. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of at the admission stage itself. There shall be no order as to costs. 20.03.2024 Index : Yes / No Speaking Order : Yes / No ksa-2 3/5
