Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarifed Mandamus calling for the entire records in connection with the order of the fourth respondent herein dated 26.11.2009 and quash the same and direct the fourth respondent to reinstate the petitioner with all other benefits.

ORDER

This Court, on an earlier occasion, after hearing the learned counsel on either side at length, suggested to the 4th respondent, whether the 4th respondent is willing to modify the punishment of dismissal from service to that of compulsory retirement.

In response to the same, today, the learned counsel for the 4th respondent placed before this Court, a letter dated 21.11.2024, addressed to him by the 4th respondent stating that the 4th respondent is willing to modify the punishment of dismissal from service, passed by an order dated 26.11.2009, to that of compulsory retirement. The learned counsel for the petitioner also submitted that the petitioner is willing to accept the same. Page No.2 of 5

In the light of the above, the adjudication of this writ petition on merits is not necessary. Accordingly, the writ petition is disposed of directing the 4th respondent to pass appropriate orders within a period of two

(2) weeks from the date of receipt of a copy of this order, duly modifying the impugned order dated 26.11.2009, modifying the punishment of dismissal from service to that of an order of compulsory retirement, and release all consequential benefits for which the petitioner would be otherwise entitled to, within a further period of six (6) weeks. The connected miscellaneous petition is closed. No costs.
