PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Certiorarified Mandamus after calling for the records relating to the order dated 30.06.2004 in I.A.No.8 of 2004 in I.D.No.83 of 2002, quash the same and consequently direct the first respondent to implead the respondents 4 and 5 herein as II party/third and fourth respondents in I.D.No.83 of 2002 and award costs.

The justification adduced by the petitioner for impleading the respondents 4 and 5 herein is beyond the scope of the reference made and the Labour Court has also taken note of this fact and held that the petitioner has not established that the presence of the Indian Overseas Bank or the Ministry of Finance is necessary for complete and effective adjudication.

2. The main relief sought for is as against the respondents 2 and 3 and I do not find any reason as to why the respondents 4 and 5 should be made as party respondents. As such, I do not find any reason to interfere in the orders of the first respondent.
