Respondents Prayer: Petition filed under Sections 10 and 12 of the Contempt of Courts Act, 1970, to issue notice of contempt to the respondents, to show cause why they must not be punished for contempt of the order dated 11.06.2013 in W.P.No.46099 of 2002.

ORDER

(Delivered by the Hon'ble Mr. Justice S.M.SUBRAMANIAM) Mr.Vishnu Mohan, learned counsel appearing on behalf of the petitioner would rely upon the judgment of the Division Bench of this Court dated 08.03.2024 in W.A.No.666 of 2015, wherein, the Division Bench held that the procedure contemplated under the Revenue Standing Order No.24A is to be followed.

2. In the case on hand, the aforesaid Revenue Standing Order would not be applicable, since the lease expired and not renewed

and the petitioner continue to be in possession without paying the arrears of rent. Thus, the petitioner is an unauthorized occupant for all purposes and the Government is entitled to initiate action to resume the Government land by following due process.

3. In view of the orders passed in the writ appeal and the writ petition, the present contempt petition stands closed. (S.M.S., J.) (C.K., J.) 21.06.2024 Index : Yes/No drm
