The petitioners in Crime No.965 of 2020 registered by the respondent police for the offences punishable under Sections 294(b), 323, 324 and 506(ii) of IPC r/w Section 4 of Prohibition of Harassment of Women Act, 2002 seek anticipatory bail .

2.The petitioners herein seek anticipatory bail . They are accused in C.C.No.105 of 2023, now pending before the learned Judicial Magistrate-II, Kanchipuram. Originally, Cr.No.965 of 2020 had been registered by the respondent under Sections 294(b), 323, 324 and 506(ii) IPC r/w Section 4 of Prohibition of Harassment of Women Act, 2002.

3. It is informed that in Crl.MP.No.1060 of 2020, anticipatory bail has been granted to 1st, 3rd , 4th and 5th petitioners. However, they did not execute sureties owing to the Covid-19 pandemic. Taking that factor into consideration, impressing upon the learned Judicial Magistrate-II, Kanchipuram where C.C.No.105 of 2023 is pending to examine the 1/3

scope of Rules 22 and 24 of the Criminal Rules of Practice, though the petitions are dismissed, a direction is given that the petitioners/1, 3, 4 and 5 must surrender before the said Court and on the same day if the records are available, then orders may be passed by the learned Judicial Magistrate.

4. So far as the 2nd petitioner is concerned, it is stated that he had neither obtained anticipatory bail nor had been granted bail. An absconding charge sheet has been filed against him. Therefore, this petition stands dismissed with direction to surrender before the said Court. If the records are available, then the learned Judicial Magistrate may consider his application on the same day. 5.With the above directions, this Criminal Original Petition in respect of the 1st, 3rd 4th and 5th petitioners is disposed of. The Criminal Original Petition in respect of the the 2nd petitioner stands dismissed. Vv 19.02.2024 2/3
