ORDER

The petitioner has filed the present writ petition seeking to issue a Writ of Mandamus to direct the respondents to disburse the terminal benefit accrued in her husband's account under death cum gratuity under group insurance scheme and other benefits within the time framed by this Court and to appoint the petitioner on compassionate grounds. 2.

Heard the learned counsel for the petitioner and none appeared for the respondents.

The petitioner's husband was appointed as Assistant in the respondents Office and he died on 02.10.2003. After the death of her husband, the petitioner approached the respondents with all relevant documents such as death certificate and other relevant documents for claiming terminal benefits of her husband. The application is pending with the first respondent from 17.12.2003 onwards and the applications for settlement of Provident Fund and Gratuity dated 03.03.2004 are also pending with the first respondent.

The learned counsel for the petitioner submitted that though the petitioner filed the writ petition, seeking for a Mandamus, she confined the relief to the extent of directing the respondents to consider her application

dated 17.12.2003 and pass orders.

Accordingly, this Court is inclined to issue direction to the first respondent to consider the application of the petitioner dated 17.12.2003 and pass orders, on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this Order. The petitioner is directed to send a copy of the application to the first respondent along with the copy of this order, enabling the first respondent to pass orders.
