Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondent to promote the petitioners to the promotion post of BT Assistant.

ORDER

The prayer in this writ petition is for a mandamus directing the respondents to promote the petitioners to the post of B.T. Assistant.

2. When the matter is taken up for hearing today, Mr.V.Nanmaran, learned Additional Government Pleader (Education) appearing for the respondents has produced the proceedings of the District Education Officer, Thenkanikottai in Na.Ka.No.3019/A4/2021 dated 14.12.2021, wherein it has been stated that the petitioners 1 and 3, namely Tvl. R.Suresh Kumar https://hcservices.ecourts.gov.in/hcservices/

and K.Jagatheesan were already promoted on 11.03.2013 and 1406.2018 respectively and insofar as the fifth petitioner/S.Sankari is concerned, the said candidate had expressed her desire to give up her promotion and therefore, recording the same, promotion was not given to her and insofar other two writ petitioners, namely Tvl.P.S.Mohan and S.Jagadesh are concerned, after 2012, as per the policy decision, such promotion sought for by them cannot be granted and accordingly, it was not granted. The aforesaid proceedings dated 14.12.2021 was also communicated to the petitioners by the respondents on 15.12.2021 and the copy of the same was also handed over to the learned counsel for the petitioners by the learned Additional Government Pleader.

3. In view of the above said proceedings of the District Educational Officer, Thenkanikottai dated 14.12.2021, this writ petition stands dismissed as infructuous. If the petitioners are aggrieved by the said order dated 14.12.2021, it is always open to challenge the same in the manner known to law. No costs. Consequently, connected miscellaneous petition is dismissed.
