ORDER

The petitioner, who was arrested and remanded to judicial custody on 22.12.2025 for the alleged offence punishable under Sections 126(2), 127(2), 296(b), 74, 76, 351(3) of BNS Act & Section 4 of TNPHW Act, in Crime No.509 of 2025, registered on the file of the respondent police, seeks bail. 1/5

2. The allegation against the petitioner is that he is an accused in a POCSO case lodged by the victim, in which he was arrested and subsequently released on bail. It is further alleged that, after the victim attained majority, the petitioner again intercepted her and continuously demanded that she join him and since she refused, the petitioner attacked her in a public place and caused severe injuries by pulling her dupatta and pushing her down. When the same was questioned by others, the petitioner threatened them with dire consequences. Hence, the present case has been registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody for substantial period and that the investigation is concluded. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that this is the second occurrence committed by the petitioner on the very same victim, if the petitioner is released on bail, he will indulge in similar offence. Hence, he opposed to grant bail to the petitioner.

5. On perusal of the materials on record, this Court finds that the present case and the previous case are similar in nature, and that in both cases the petitioner caused injuries to the victim. Earlier, the victim was a child and, now, 2/5

she is a college-going student, and that the petitioner is alleged to have humiliated and insulted her by attacking her in a public place and threatening her with dire consequences. Therefore, this Court is not inclined to grant bail to the petitioner

6. Accordingly, this Criminal Original Petition is dismissed. 02.02.2026 drl To
