PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order of the 1st respondent in Se.Mu.Na.Ka.Pa.E4/9142/2008 dated 22.09.2009 and the consequential order of the 2nd respondent in Na.Ka.No.A6/385/2009 dated 15.10.2009 and quash the same and direct the respondents 1 and 2 to appoint the petitioner as Noon Meal Organiser in the place of the 3rd respondent and grant all consequential benefits to the petitioner. 1/4

ORDER

The Writ Petition is filed calling for the records relating to the impugned order of the 1st respondent in Se.Mu.Na.Ka.Pa.E4/9142/2008 dated 22.09.2009 and the consequential order of the 2nd respondent in Na.Ka.No.A6/385/2009 dated 15.10.2009 and quash the same and direct the respondents 1 and 2 to appoint the petitioner as Noon Meal Organiser in the place of the 3rd respondent and grant all consequential benefits to the petitioner.

2.Learned counsel for the petitioner and 1st and 2nd respondents are present. There is no representation for the 3rd respondent. 3.When the matter is taken up, learned counsel for the 1st and 2nd respondents submitted that petitioner was appointed as Cook Assistant on the basis of the proceedings in Na.Ka.No.BE4/2721/2017 dated 2/4

21.06.2017 and subsequently, she was promoted as Cook by proceedings in Na.Ka.No.294/2022/BE4 dated 27.08.2022.

4.The copy of the proceedings are also produced for the perusal of this Court.

5.In view of the subsequent development of appointment of the petitioner as Cook Assistant and promoted as Cook, this Court is of the view that, there is nothing more to decide in this Writ Petition. 6.Accordingly, this Writ Petition is dismissed as infructuous. No costs.
