O R D E R

This Criminal Original Petition has been filed to direct the respondents to give adequate Police protection to the life and limb of the petitioner as well as the family members of the petitioner on the basis of his representation to the respondents dated 05.01.2022.

2. The case of the petitioner is that he is running the Transport in the name and style of Saravana Transport. The petitioner had purchased the property in Natham Survey No.3 to an extent of 3300 sq.ft. in Pammal Village, Pasumpon Nagar, Girikori Street, Tambaram Taluk, Kancheepuram District from one Padmavathi on 09.09.2019. The petitioner is a native of Madurai and he had gone to Madurai for the purpose of his business and during that time, the respondents 4 and 5 had put up a panthal in the property of the petitioner and attempted to grab the property. The petitioner had given a complaint against the respondents 4 and 5 to the 3rd respondent on 01.10.2018 to take proper action against them and he was also issued CSR.No.1035/2018 and the enquiry is pending. While so, on 26.12.2021, the 4th and 5th respondents along with unknown persons attempted to put up structure and also threatened the petitioner and the petitioner has given a representation to the respondents 1 to 3 on 05.01.2022. Since no action has been taken, the petitioner has approached this Court.

Mr.A.Gokulakrishnan, learned Additional Public Prosecutor appearing for the respondents would submit that there is civil dispute pending between the petitioner and the respondents 4 and 5 in respect of the property. The respondents police had conducted an enquiry and had advised the petitioner to approach the jurisdictional Civil Court to get appropriate orders. He would further submit that since there is dispute with regard to the ownership, the respondents police have not interfered with this case.

4. Recording the above submission made by the learned Additional Public Prosecutor, this Criminal Original Petition stands disposed of.
