Respondent Prayer: Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to direct the respondent police viz, the Inspector of Police, Economic Offence Wing, Salem City, Salem District to take further action in the above matter based on the complaint sent by the petitioner herein to the respondent herein on 31.12.2019.

ORDER

This petition has been filed to direct the respondent police to take further action on the petitioner's complaint dated 31.12.2019.

2. The learned counsel for the petitioner has submitted that the petitioner got acquaintance with one V.Elangovan who is a resident of Sooranatham Village, Arur Taluk, Dharmapuri District and he is working as Head Master of Panchayat Union Elementary School at Kottapatti Village. He further submitted that the said Elangovan informed the petitioner that he will make arrangement for getting Government job to the petitioner and his wife and hence he received a sum of Rs.10,00,000/- and another sum of Rs.5,00,000/- was paid to one Radhakrishnan for getting a job as Jeep driver in the office of Revenue Department. He further submitted that the petitioner has also paid a sum of Rs.16,00,000/- to one Antony of Purathakudi 1/3

Village in Musiri Taluk, Tiruchy District for getting a job for Group-2A post conducted by TNPSC. He further submitted that the petitioner has paid a sum of Rs.9,00,000/- to one Veera Pandian of Purathakudi Village, Musiri Taluk, Tiruchy District for getting a post of Village Administrative Officer. He further submitted that the petitioner has paid a sum of Rs.4,00,000/- to one Pavul Pushparaj of Konalai Village in Musiri Taluk, Tiruchy District for getting a post of Village Administrative Officer.

The learned counsel for the petitioner has further submitted that the aforesaid persons have not made any arrangement for getting job to the petitioner or his wife and hence the petitioner has lodged a complaint before the Inspector of Police, Kottappatti Police Station, Dharmapuri District on 08.12.2019 and after receipt of the said complaint, the said Inspector of Police has issued CSR.No.105 of 2019 and thereafter he has not taken any action on the said complaint. He further submitted that since the amount involved in this case is huge, the petitioner has sent a complaint to the Deputy Superintendent of Police, EOW, Salem and others on 31.12.2019 by RPAD, but so far no action has been taken on the said complaint also. Hence, he requests to direct the respondent police namely, Inspector of Police, EOW, Salem District to take action on the petitioner's complaint dated 31.12.2019.

The learned Additional Public Prosecutor has submitted that since the complaint is relating to job racketing, the respondent is not having jurisdiction to investigate the said matter and hence he sent the said complaint to the Superintendent of Police, Salem District to forward the same to the Superintendent of Police, Dharmapuri District.

This Court by taking judicial notice, that CBCID, Chennai is investigating the matter with regard to job racketing of Group 2.A post and other posts, the Superintendent of Police, Salem District is directed to forward the petitioner's complaint to the CBCID, Chennai and that the CBCID, Chennai is directed to investigate this matter also. If the CBCID finds that this case is not related to the matters which are already under their investigation, they may transfer this matter to the concerned investigating agency.

6. With the aforesaid directions, this Criminal Original Petition is disposed of.
