Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorari to call for the records of the respondent in his proceeding R.C.No.3495/2002/Sa.Pa dated 28.03.2003 and quash the same.

ORDER

This Writ Petition has been filed challenging the proceeding of the respondent in R.C.No.3495/2002/Sa.Pa dated 28.03.2003 and quash the same.

2. When the matter is taken up for hearing today, there is no representation for the petitioner. Even on earlier occasion, there was no representation for the petitioner.

3. The learned Special Government Pleader (Co-operative Society) appearing for the respondent would submit that the petitioner filed this writ petition challenging the proceeding https://hcservices.ecourts.gov.in/hcservices/

in R.C.No.3495/2002/Sa.Pa dated 28.03.2003 and subsequently, during the pendency of the writ petition, the respondent recovered the entire money from the petitioner and therefore, the writ petition has become infructuous. He has also produced a copy of the proceeding in Na.Ka.No.3022/2020/Sa.Pa dated 03.12.2020 before this Court.

4. Considering the submission made by the learned Special Government Pleader and since there is no representation on behalf of the petitioner and even the writ petition is pending from the year 2004, nothing survives in this writ petition for further adjudication. Accordingly, the Writ Petition stands dismissed as infructuous. No costs. Connected miscellaneous petition is closed.
