JUDGMENT
The petitioner accused for the offence under Sections 341, 342 and 376 r/w 511 IPC and sentenced to undergo rigorous imprisonment as under :-

Offence under Conviction and Sentence Sec. 341 IPC Convicted & Sentenced to undergo RI for one month and pay fine of Rs.250/-, i/d RI for two weeks Sec. 342 IPC Convicted & Sentenced to undergo RI for 6 months and pay fine of Rs.500/-, i/d RI for one month Sec. 376 r/w Convicted & Sentenced to undergo RI for 7 years and pay fine of Rs.2,000/-, i/d RI for six months The sentence were ordered to run concurrently. The accused / appellant, aggrieved by the said judgment, has preferred the present appeal.
2. When the matter is taken up today for hearing, learned Addl. Public Prosecutor, appearing for the respondent submitted that the accused / appellant has served out the sentence imposed on him by the Sessions Court. It is further evident from the records that the appellant has been in incarceration since 13.10.2010 as is evident from the letter written by the Superintendent of Prisons, Central Prison - I, Chennai, to the Registrar General, High Court, Madras. From the above, it is evident that the appellant has served the sentence imposed upon him. In such view of the matter, the appellant having completed the period of sentence imposed upon him, nothing survives for consideration in this appeal, as the appeal is not argued on merits.
3. Accordingly, this appeal has become infructuous and the same is dismissed as infructuous. The appellant, Peter @ Alexander, is directed to be released forthwith, if not released already, unless his custody is required in connection with some other case.
