Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to pay 10% interest towards belated payment of terminal benefits such as gratuity, provident fund, leave salary and commutation amount to the petitioners. ORDER

This Writ Petition has been filed in the nature of a Mandamus, seeking a direction against the respondents to pay interest at 10% per annum for the delayed payment of terminal benefits, such as gratuity, provident fund, leave salary and commutation amount, to the petitioners.

2. The writ petitioners had joined the service of the first respondent as Conductors, Drivers, and Technical Staff. After putting in nearly 28 to 30 years of continuous service, they had retired on attaining the age of superannuation, on various dates. It is contended that the gratuity, provident fund, leave salary, and commutation amount had not been settled. It has been stated that they were settled much later, after retirement. Now, by this

Writ Petition, they claim interest at the rate of 10% per annum.

3. The respondents may examine each one of the cases individually and examine the reason for the belated payment of gratuity, provident fund, leave salary, and commutation amount. The respondents are under an obligation to pay interest at the rate of 6% per annum. The amount may be disbursed within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above observations, this Writ Petition is disposed of. No costs.
