Writ petition filed under Article 226 of the Constitution of India seeking to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned communication Letter No.18306/AA-2/05-4 dated 11.04.2006 issued by the Agricultural Production Commissioner and the Secretary to the Government, the respondent herein and quash the same and consequentially to issue directions to the respondent to give the promotions to the petitioner that were due to him with due seniority and with retrospective effect from the date on which the petitioner should have been promoted.

ORDER

This writ petition has been filed seeking Writ of Certiorarified Mandamus to quash the impugned communication Letter No.18306/AA-2/05-4 dated 11.04.2006 issued by the respondent and consequently, direct the respondent to give promotion to the petitioner.

2. At the time of admission, no interim order has been granted.

The learned Government Advocate, appearing for the respondent submitted that, pending writ petition, the respondent had concluded the disciplinary proceedings and passed final order on 06.04.2011, dismissing the petitioner from service. Therefore, the prayer sought for in this writ petition has become infructuous and nothing survives for further adjudication. The learned Government Advocate has also filed typed set of papers containing all the papers of the disciplinary proceedings, including the final order passed on 06.04.2011.

4. Recording the submission made by the learned Government Advocate, this writ petition is dismissed as infructuous. No costs.
