Delay of 137 days in representing the appeal is satisfactorily explained. Delay is condoned.
2. We have heard the appeal challenging the finding of negligence. Prima facie satisfied. Therefore, we deem it fit to admit the appeal and issue notice through Court as well as privately to the respondents returnable in four weeks. Registry is directed to number the appeal.
3. In the meanwhile, the appellant / Insurance Company, is directed to deposit the entire award amount with proportionate interest and cost, less the statutory deposit to the credit of MCOP No.209 of 2013 on the file of Motor Accident Claims Tribunal (Additional District and Sessions Judge) Ariyalur, within four weeks from today. The amount deposited shall not be permitted to be withdrawn without the leave of this court.
