ORDER

This Criminal Miscellaneous Petition has been filed seeking to modify the conditions imposed by this Court vide order dated 12.06.2025 in

Crl.R.C.No.731 of 2025 and permit the petitioner to execute the bond and furnish surety before the Judicial Magistrate-III, Thirupathur District.

2. Heard the learned Government Advocate (Crl.Side) appearing for the respondent Police.

3. The learned counsel for the petitioner would submit that the petitioner does not have any title deed so as to comply the conditions dated 12.06.2025 passed by this Court in Crl.R.C.No.731 of 2025. While referring to the said order this Court had directed the learned Judicial Magistrate-III, Tirupathur, to return the cash of Rs.5,90,000/- on deposit of the original title deeds stands in the name of the petitioner.

4. The above order explicitly makes it clear that unless the petitioner deposits the original title deed, the question of releasing the above amount doest not arise. Now, the learned counsel for the petitioner would submit that the petitioner has no title deeds. In such circumstances, taking into consideration of the peculiarity of this case, this Court is not inclined to modify the conditions. Accordingly, this Criminal Miscellaneous Petition is dismissed. 10-03-2026 MPA
