ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 9(1), 9(n), read with Section 10 of POCSO Act in connection with the Cr.No.10 of 20245, seeks anticipatory bail.
2. The allegations against the petitioner are that the petitioner who is step father of the victim, subjected the defacto complainant to sexual assault on several occasions and threatened her with dire consequences. Hence, the case.
3. Learned counsel for the petitioner submitted that the petitioner is an innocent person, and due to matrimonial dispute between the petitioner and the mother of the victim girl, a false case has been registered against the petitioner and he is ready to cooperate for the investigation. Hence, the learned counsel prays for gran to anticipatory bail to the petitioner.
4. Learned Government Advocate (Criminal Side) appearing for the respondent police, reiterated the prosecution case and has produced the copy of statement of the victim girl recorded under Section 183 of BNSS Act and further submitted that investigation in this case has been completed, final report filed and the same has been taken cognizance in Spl.SC.No.365 of 2025, on the
file of the learned Sessions Judge, Special Court of Executive Trial of Cases under POCSO at Chennai and summons for appearance of the petitioner was issued.
5. Since there is no apprehension of arrest of the petitioner at this point of time, this Criminal Original Petition is closed. The Petitioner is directed to appear on receipt of summons, from Trial Court 29-01-2026 Index: Yes/No Speaking/Non-speaking order JAI
