ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 147, 148, 294(b), 323, 506(ii) and 306 of IPC, in Crime No.129 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that there was wordy quarrel among the deceased one Kumar, petitioner and other accused persons at birth day function, in which, the petitioner and other accused persons had scolded the deceased Kumar and later, he had decided to commit suicide by jumping before the train. Hence, the complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner is is ranked as A2 and he is an innocent person and no way connected in the alleged committal of suicide by the deceased. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) raised objection stating that due to the harassment made by the A1 along with some of the students the deceased committed suicide before the Sub Urban train. He further submitted that the co-accused already been arrested and released on bail and the investigation almost completed.

5. Considering the facts and circumstances of the case and also considering the submissions made by the both counsel and the investigation almost completed and he is being the student of Pachaiyappa College,this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate Court - No.I, Thiruvallur, and on further conditions that:

[a] the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Court concerned may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioner shall report before the respondent police on every Saturday at 10.30 a.m., for a period of three months and thereafter as and when required for an interrogation; [c] the petitioner shall not tamper with evidence or witness either during investigation or trial;

[d] the petitioner shall not abscond either during investigation or trial;

[e] on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions has been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

[f] if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC;
